The descriptions of items appearing in advertising prior to this auction are believed to be correct. Nevertheless, neither those descriptions nor any oral statement made by the owner (or his agents or officers) or by the Auctioneers (or his agents or officers) concerning any item shall be construed as a warranty, either expressed or implied. I, bidder have examined this merchandise and accept it the way it is. All mileage, hour meters, & Description on vehicles and equipment are not guaranteed by auction company or any of its representatives. DISPUTES: The Auctioneers shall designate the winning bidder after each item is auctioned off. If a dispute arises between two or more bidders, the Auctioneers reserve the right to reopen the bidding. The Auctioneers designation of a buyer shall be final. BINDING ARBITRATION: The Parties agree that in the exclusive course of action an any litigation or dispute concerning the enforcement of this agreement shall be by binding arbitration within County of Adams, State of Indiana and the Indiana laws shall govern. INJURY AND DAMAGE AND HOLD HARMLESS: Bidder acknowledges responsibility for any Personal injury property damage caused by bidder or his agent, and further agrees to hold auctioneers and owner harmless for any and all personal injury to himself or his agents and any property damage incurred on auction premises. Buyer agrees to hold auctioneers and owner, their agents or employees, harmless from any and all suits, claims damages, cost and expenses of every kind and nature which may or might be asserted against the auctioneer or owner, their agents or employees, resulting from the actions or inaction of buyer. Buyer agrees and understands that by law employers are required to carry workers compensation coverage for its employees. Buyer is responsible for the providing of worker’s compensation, liability and property damage insurance as respects their property and contractual obligation. AGENTS ONLY: The auctioneers are acting as the owner’s agent only. Not Responsible for no show items call ahead to confirm items are onsite.

    Title Info: $35 Title processing fee PER TITLED ITEM. *Payments accepted: Invoices under $2,000.00 Credit Cards will automatically be charged at the conclusion of the auction, Any invoice totaling over $2,000 will be charged a $1,000 downpayment at the conclusion of the auction, with the option to pay the remaining balance with Cash, check, or credit card. All Payments are due by June 18th @ 5:00 PM EST or credit card on file will be charged. All payments must be made prior to pick up. Krueckeberg Auction & Realty and or the sellers will not issue duplicate titles once titles are in buyers possession.     If you are tax exempt, please download, fill out, and return one of the following forms. Tax will not be removed from your invoice until this documentation is received. 

    If you purchased any item that has a title, please fill out and sign section D of this ST108A.
    If you purchased any item that does not have a title, please fill out this ST105
    If you are a dealer claiming tax exemption, please send a copy of your dealers license to [email protected]
